Terms & Conditions


All written and verbal information shared by the Company with the Channel Partner under this Agreement is considered Confidential Information. This applies regardless of when the information was provided—whether before or after the date of this Agreement—or the manner in which it was communicated.

Upon the expiration or termination of this Agreement, the Channel Partner must return to the Company all documentation, records, or Confidential Information that belongs to the Company.

The Channel Partner, Homeworx India, is not authorized to make any unauthorized statements or send any written communications regarding the Company or its projects in any format without prior written consent from the Company. Any unauthorized communication shared with a customer will not be binding on the Company, and Homeworx India will be solely responsible for any resulting claims, losses, or damages. If such an incident is reported to the Company, it reserves the right to suspend or cancel the registration of Homeworx India without prejudice to its rights and remedies. This may also lead to the forfeiture of any outstanding payments due, including commissions and other receivables, as well as potential legal action by the Company and its affiliates.

The Channel Partner may only make representations to prospective customers or clients in accordance with those provided by the Company on the RERA website. The Company will not be liable for any other representations made by the Channel Partner and is not bound by them. The Channel Partner agrees to indemnify the Company for: i) any breach of the Channel Partner's representations or responsibilities, ii) any claims against the Company by a third party, customer, or client due to breaches committed by the Channel Partner, and iii) any instances of misrepresentation.

The Channel Partner acknowledges that, according to the Company's policies, no fees will be payable for transactions in which the Channel Partner, including individuals, sole proprietors, partners, directors, shareholders, or the Company itself, has applied for or purchased units in the Company's (or its group companies’) projects. Consequently, the terms for brokerage payment under this Agreement will not apply to such transactions. If the Company is informed that brokerage has been claimed for these transactions, it reserves the right, without prejudice to its rights and remedies, to set off, recover, withhold, adjust, or reclaim any payments due or already paid to the Channel Partner for those transactions. The Channel Partner agrees not to raise any objections or make claims regarding such adjustments or set-offs, and any claims related to this will be deemed waived by the Channel Partner.
